พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดช ทรงพระกรุณาโปรดเกล้าโปรดกระหม่อมให้ตรา พระราชบัญญัติข้อมูลข่าวสารของราชการ พ.ศ. ๒๕๔๐ ขึ้นไว้โดยคำแนะนำและยินยอมของรัฐสภา เนื่องด้วยในระบอบประชาธิปไตย การให้ประชาชนมีโอกาสกว้างขวางในการได้รับข้อมูลข่าวสารเกี่ยวกับการดำเนินการต่าง ๆ ของรัฐเป็นสิ่งจำเป็น เพื่อที่ประชาชนจะสามารถแสดงความคิดเห็นและใช้สิทธิทางการเมืองได้โดยถูกต้องกับความเป็นจริง และมีสิทธิได้รู้ข้อมูลข่าวสารของราชการ โดยมีข้อยกเว้นที่ไม่ต้องเปิดเผยแจ้งชัด และจำกัดเฉพาะข้อมูลข่าวสารที่หากเปิดเผยแล้วจะเกิดความเสียหายต่อประเทศชาติหรือประโยชน์ที่สำคัญของเอกชน ทั้งนี้ เพื่อพัฒนาระบอบประชาธิปไตยให้มั่นคงและจะยังให้ประชาชนมีโอกาสรู้ถึงสิทธิหน้าที่ของตนอย่างเต็มที่ เพื่อที่จะรักษาผลประโยชน์ของประชาชน และคุ้มครองสิทธิส่วนบุคคลในส่วนที่เกี่ยวข้องกับข้อมูลข่าวสารของราชการ
